AccomModation REGULATIONS
The GUEST, their INVITEES and/or the providers hired by the GUEST (jointly, the USERS), agree to comply with the following regulations (the REGULATIONS) of Hotel Campos Polanco located at Campos Elíseos 361, Colonia Polanco III Sección, Miguel Hidalgo, Mexico City, 11540 (hereinafter the HOTEL) operated by Vida Vivienda de Altura, S.A de C.V. (CAMPOS POLANCO):
1. ACCOMMODATION
· These REGULATIONS are related to the accommodation service (the SERVICE) contracted by the GUEST with CAMPOS POLANCO, whose characteristics and costs are set forth in these REGULATIONS, in the REGISTRATION FORM, in the AGREEMENT, and at www.campospolanco.com.
· Accommodation prices or additional services stated in USD$ (U.S. dollars) must be paid in Mexican pesos according to the daily Fix exchange rate published by Banco de México + 3% (to cover exchange rate fluctuations and bank commissions), which is posted at the HOTEL reception.
· The GUEST accepts and therefore agrees to comply with the REGISTRATION FORM, the AGREEMENT, the REGULATIONS, and the PRIVACY NOTICE (hereinafter the DOCUMENTS): I) by signing the REGISTRATION FORM, or ii) by making a reservation by any means to stay at CAMPOS POLANCO, and/or by accepting and/or paying for the SERVICE of CAMPOS POLANCO, which includes payment of accommodation rates, additional charges, penalties, and/or damages as set forth in the DOCUMENTS.
· The rates for the SERVICE are agreed upon in U.S. dollars and are confirmed at the time the reservation for the stay is made.
2. RESERVATIONS
· Reservations may be made through www.campospolanco.com, by phone, email, through Internet providers (e.g., Booking, Expedia, etc.) that have a collaboration agreement, or at the HOTEL reception.
· Reservations will be confirmed by email, including the details of the stay and a confirmation number. If the reservation confirmation is not received within 24 hours, please contact the hotel reception for clarification.
· Reservations through Internet providers are governed by the policies of each agency.
· To guarantee the reservation, the GUEST must make payment according to the type of reservation made and must have received written confirmation of the reservation before the beginning of the Services.
3. CHECK-IN / CHECK-OUT
· Check-in begins at 3:00 p.m. on the start date indicated in the REGISTRATION FORM, and check-out is at 11:00 a.m. on the end date indicated in the REGISTRATION FORM. A sixty-minute grace period will be granted for check-out.
· The minimum age to check-in is 18 years old. All USERS must provide official photo identification at the time of registration at reception, from which a copy will be collected.
· We value the privacy and security of our GUESTS; therefore, we require any USER entering the HOTEL to register at reception. Otherwise, entry will not be permitted to any person, nor to individuals without a prior reservation or unregistered INVITEES, even if accompanied by the GUEST.
· Upon termination of the AGREEMENT, the GUEST must check-out, vacate, and return the ROOM. Pursuant to law, CAMPOS POLANCO will record the check-in and check-out time of each USER, confirming that the registered USERS match the same number of people leaving, and if any USER continues occupying the ROOM, verification will be made by telephone or in person that they are still enjoying the SERVICE, respecting their privacy.
4. LATE CHECK-OUT
· Subject to availability, if the GUEST performs a late check-out, an additional charge will apply as follows:
o From 12:00 p.m. to 1:00 p.m., the charge will be USD$50 (fifty U.S. dollars) plus taxes.
o Between 1:01 p.m. and 6:00 p.m., the charge will be 50% of the current daily rate plus taxes.
o After 6:00 p.m., the charge will be equivalent to one additional day at the current daily rate, plus taxes, posted that day at reception.
o If the GUEST fails to check-out, they authorize, accept, and agree with the HOTEL that it may collect their luggage and place it at reception in order to free the ROOM and carry out the corresponding cleaning, without any liability for the HOTEL.
5. GUARANTEES
· The GUEST expressly authorizes the guarantee, holds, and charges indicated in the REGISTRATION FORM, the AGREEMENT, and the REGULATIONS, with the understanding that the guarantee will be calculated as follows (hereinafter the “HOLD/CHARGE”):
o The GUEST grants as a guarantee the credit or debit card indicated in the REGISTRATION FORM to guarantee compliance with their obligations and possible damages to the ROOM, the furniture and/or accessories located therein, as well as the COMMON AREAS and the HOTEL. Said guarantee shall be equivalent to USD$100 (one hundred U.S. dollars) for each day of accommodation, which will be charged when paying in advance for the SERVICE or upon receiving the ROOM at the beginning of the SERVICE.
o If the stay has not been prepaid, the difference necessary to cover the total amount of the nights of stay will also be held as a guarantee.
o In the case of a credit card, the guarantee is a HOLD posted to the credit card, which will be released upon settlement of the account. The release of the HOLD amount is subject to the timelines established by the financial institution of the card presented by the GUEST.
o In the case of a debit card, the guarantee is a CHARGE, therefore, upon settlement of the services, any balance to be refunded to the GUEST is subject to the refund timelines established by the financial institution of the card presented by the GUEST.
· In the event of chargebacks, improper claims, denial of validly authorized charges, or possible fraud related to payment methods, CAMPOS POLANCO may:
(i) submit the corresponding documentation and evidence to financial institutions;
(ii) suspend future reservations;
(iii) deny subsequent services; and
(iv) exercise the corresponding legal and collection actions.
· The GUEST shall be responsible for any charge, commission, administrative expense, financial cost, or damage arising from improper or fraudulent claims.
· Upon receiving the ROOM, the GUEST must report any damage or defects in the furniture and accessories in the ROOM or amenities by sending an email to residentservices@campospolanco.com. Upon termination of the AGREEMENT, CAMPOS POLANCO will conduct an inspection, and in the event of damage or missing items belonging to CAMPOS POLANCO, the corresponding amount to be charged to the GUEST will be previously communicated to the GUEST (attaching reasonable evidence), therefore the GUEST authorizes the corresponding charge for damages or replacement of items or property belonging to CAMPOS POLANCO to be made to the credit or debit card provided as guarantee.
6. CANCELLATIONS
· When the rate is refundable, the GUEST may cancel or terminate the AGREEMENT provided that the GUEST gives notice of the cancellation or termination to CAMPOS POLANCO by email to residentservices@campospolanco.com and according to the notice period the following shall apply:
o If notice is given at least 72 hours prior to the start date of the SERVICE, no penalty will be charged.
o If notice is given less than 72 hours prior to the start date of the SERVICE, a penalty equivalent to the first night of accommodation plus taxes will be charged.
o If the GUEST does not appear on the start date of the SERVICE, the first night of accommodation plus taxes will be charged, and the remainder of the reservation will be automatically canceled/terminated.
o Once the SERVICE has started, and if the GUEST cancels or terminates their stay before the end of the original term, one additional night of accommodation plus taxes will be charged.
· In the case of non-refundable rates, there will be no refunds for cancellations or modifications under any circumstances.
7. OCCUPANCY
· The daily rates contemplate occupancy of one or two people per ROOM.
· Subject to availability, additional GUESTS are welcome at a cost of USD$75 (seventy-five U.S. dollars), plus taxes, per person for each night of stay. Additional beds may be added subject to availability and the capacity of each ROOM. Please notify residentservices@campospolanco.com if you need to add additional persons and/or require an extra bed.
8. MINORS
· Children under 12 years old do not pay an additional rate. Subject to availability, if an additional bed for minors and/or Pack’n Play cribs for babies is needed, these must be requested at residentservices@campospolanco.com.
· Minors under 18 years of age (children and adolescents) must register by validating their identity and relationship through an official document. The kinship or relationship of the accompanying adult will be recorded, and said adult will be registered as responsible, in accordance with applicable local law.
9. FOOD AND BEVERAGES
· The daily rate includes:
o Breakfast from 7:00 a.m. to 11:00 a.m., consisting of fruit, granola, sweet bread, juice, coffee, and tea, as well as the dish of the day chosen by CAMPOS POLANCO.
o A beverage from 5:00 p.m. to 10:00 p.m. selected by CAMPOS POLANCO.
· All ROOMS have a minibar with a variety of products and beverages at an additional cost according to the menu available in each ROOM.
· We have a food and beverage menu at an additional cost for consumption in the ROOMS and all COMMON AREAS from 11:00 a.m. to 10:00 p.m.
10. AMENITIES
· CAMPOS POLANCO provides amenities for the comfort of its GUESTS and for use during the SERVICE. If the GUEST wishes to take the amenities with them (shampoo, conditioner, soap, lotion, robes), they may be purchased at an additional cost according to the price list available in each ROOM.
· All our ROOMS have cable service, Chromecast, and Sonos speakers. If the GUEST wishes to bring audio and/or video equipment, they do so at their own responsibility, and in such case must register the equipment at the HOTEL reception.
· We offer free Wi-Fi for our GUESTS throughout the HOTEL.
11. COMMON AREAS
· The COMMON AREAS include EL LOUNGE, EL PATIO, LA BIBLIOTECA, EL ESTUDIO, LA SALA, EL GIMNASIO, and/or LA AZOTEA and are available from 7:00 a.m. to 10:00 p.m.
· The GUEST may use the COMMON and/or social AREAS subject to availability. If exclusivity is required, they must be contracted and paid for in advance and separately from the SERVICE.
12. PET FRIENDLY
· The cost per pet per stay is USD$75 (seventy-five U.S. dollars) plus taxes. Service animals or guide dogs stay free of charge.
· The GUEST is responsible for the behavior of their pet(s) and for any damage they may cause, including cleaning up after their pet(s) at all times and disposing of waste properly.
· Pet(s) must be leashed at all times when outside the ROOM and may not be left alone in the ROOM. During ROOM cleaning, pet(s) must remain inside a cage or pet carrier.
· If there are complaints from other GUESTS related to the pet(s), CAMPOS POLANCO reserves the right to request that the GUEST find an alternative place outside CAMPOS POLANCO for their pet(s).
13. CLEANING
· The GUEST must allow staff access to carry out ROOM cleaning under CAMPOS POLANCO guidelines; otherwise, they must express their refusal during their stay. In the event that the ROOM requires deep cleaning for reasons attributable to the GUEST, including the behavior of their pet(s) or their INVITEES, or if the GUEST requests it via email at residentservices@campospolanco.com, they shall pay an additional cost of USD$75 (seventy-five U.S. dollars), plus taxes, each time an event requiring such cleaning occurs.
14. PARKING
· The daily parking cost exclusively for GUEST(S) is USD$25 (twenty-five U.S. dollars) plus taxes.
· The GUEST releases CAMPOS POLANCO from liability, damage, or impact arising from the use of its parking facilities, unless such damage is attributable to CAMPOS POLANCO.
· The HOTEL does not provide parking or valet parking services for the GUEST’S visitors; therefore, the GUEST, under their own responsibility and expense, must hire the corresponding service from a third party, hereby releasing CAMPOS POLANCO from liability, damage, or impact generated by said provider.
· At check-in or at the time the GUEST enters the HOTEL with a vehicle, the vehicle information will be recorded by the HOTEL.
15. LOST ITEMS
· The USERS agree to release CAMPOS POLANCO from any liability regarding the goods they bring into the ROOMS and the HOTEL even if they have reported them to CAMPOS POLANCO or if they were inside the safe located in their ROOM. CAMPOS POLANCO assumes no responsibility for the loss of money, jewelry, or other valuables.
16. PACKAGES
· The GUEST shall notify CAMPOS POLANCO in writing about any package/courier sent to the GUEST and/or ROOM, indicating the estimated arrival date. The GUEST is responsible for ensuring that all shipments clearly contain the address of CAMPOS POLANCO. CAMPOS POLANCO is not responsible for loss, damage suffered by packages, or their storage.
17. NON-DISCRIMINATION
· At CAMPOS POLANCO we do not discriminate; therefore, access to or provision of accommodation services shall in no way be denied, excluded, or differentiated for any person or social group due to ethnic origin, nationality, race, language, sex, gender, age, disability, legal, social or economic condition, indigenous identity, gender identity, physical appearance, health conditions, religion, ways of thinking, sexual orientation or preference, tattoos, or any other reason intended to impede the enjoyment and exercise of human rights.
18. SMOKE-FREE SPACE
· USERS may not smoke electronic cigarettes (vapes), cigarettes, pipes, cigars, or similar products inside the ROOMS, COMMON AREAS, or the HOTEL, as the entire HOTEL is a smoke-free space. In case of non-compliance, the USER shall pay an additional charge of USD$250 (two hundred fifty U.S. dollars), plus taxes, as cleaning fee for each affected area. This charge shall also apply if caused by INVITEES or providers hired by the GUEST.
19. PROHIBITIONS FOR USERS
· Noise greater than 65 decibels may not be reproduced or generated in the HOTEL. Likewise, sound reproduced or generated by USERS must not carry into hallways, COMMON AREAS, or other ROOMS. CAMPOS POLANCO may reasonably determine the volume level to be used in audiovisual playback devices in COMMON AREAS.
· May not obstruct or use hallways, stairways, and other passage areas within the HOTEL except for transit, nor may they hold parties (unless in an area specifically designated for such purposes), create noise, or perform acts that disturb the safety or tranquility of other GUESTS, or the stability, safety, health, or comfort of the ROOM(S) and/or COMMON AREAS, unless it is a COMMON AREA dedicated or rented for such purposes and provided that the policies of said area are followed.
· May not use the HOTEL COMMON AREAS outside the established schedule or when there is a private event.
· Must not use offensive language or engage in discriminatory acts or acts contrary to morals and good customs toward other GUESTS, USERS, HOTEL staff, or any third party within the HOTEL.
· Are prohibited from altering or damaging the ROOM(S), COMMON AREAS, and/or the furniture located therein.
· May not possess or introduce hazardous, corrosive, harmful, or flammable substances into the ROOM(S) or COMMON AREAS, nor perform illegal acts, introduce, consume, or commercialize drugs, illegal substances, psychotropics, narcotics, or psychoactive substances within the ROOM(S) or COMMON AREAS. In the event USERS damage the ROOM(S) or COMMON AREAS or their acts generate closure orders or fines, they must hold CAMPOS POLANCO and the HOTEL harmless and shall pay the fine or amount generated by their act.
· May not assign, sublease, transfer, lend, or commit the use or enjoyment of the ROOM to third parties, since accommodation is a service and does not grant the right to dispose of the ROOM.
· The following activities are strictly prohibited: i) access, entry, or use of any type of weapon in the HOTEL, as well as ii) carrying out activities for the purposes of prostitution or sexual abuse, human trafficking, or any act of exploitation of persons (sexual, economic, etc.) within the HOTEL.
20. THIRD-PARTY CONTRACTS
· CAMPOS POLANCO offers third-party services unrelated to accommodation services, for which it bears no responsibility regarding the service or the price, including: spa, laundry, transportation service, and tours; therefore, the guarantee and quality of such services are provided by said third parties.
21. GROUPS
· These REGULATIONS apply to reservations of up to two ROOMS. If a group reserves more than two rooms, group policies shall apply, which may be requested at sales@campospolanco.com.
22. SOCIAL MEDIA
· If USERS share photographs or videos on their social media and/or tag CAMPOS POLANCO, they authorize CAMPOS POLANCO to use the material for marketing/advertising/social media purposes, even when images of persons appear (unless they are under 18 years old), with the signed REGISTRATION FORM serving as the corresponding authorization.
23. VIDEO SURVEILLANCE
· In accordance with Mexico City laws, CAMPOS POLANCO has installed video surveillance systems at the HOTEL’s vehicle entrance and exit, as well as in the COMMON AREAS, parking lot, and pedestrian access points, which allow full identification of the faces of persons who pass through or remain in the HOTEL. Recordings are kept and safeguarded for 90 calendar days and may only be delivered to competent authorities upon formal and justified request, judicial order, and/or prosecutorial order.
· There are no cameras, systems, or video surveillance devices inside ROOMS, restrooms, changing rooms, or any space for intimate or private use.
24. INTELLECTUAL PROPERTY
· The trademarks, logos, and designs, as well as copyrights and, in general, intellectual property rights found in the ROOM(S), amenities, COMMON AREAS, the HOTEL, or CAMPOS POLANCO are the property of CAMPOS POLANCO or of the persons who granted it a license thereto; therefore, the GUEST may not copy, duplicate, or claim ownership thereof, nor modify or alter them in any manner, under penalty of liability for any damages caused thereby.
25. HEALTH MEASURES
· USERS agree to comply with the protocols and health measures established by the Federal Government or Mexico City authorities in the event of a health contingency, as well as to respect the safety measures implemented at CAMPOS POLANCO.
26. INSURANCE
· In accordance with NOM-07-TUR-2002, CAMPOS POLANCO has civil liability insurance covering damages to third parties and their property and persons.
27. FORCE MAJEURE
· CAMPOS POLANCO is not responsible for accidents suffered by the GUEST, events, or damages caused to the GUEST due to unforeseen events, force majeure, or third parties unrelated to CAMPOS POLANCO.
· An unforeseen event or force majeure is any fact or event beyond one’s control that is unforeseeable, irresistible, insurmountable, current, and does not arise from negligence or provocation by CAMPOS POLANCO.
· CAMPOS POLANCO shall only be obligated, as applicable and reasonably possible at its discretion, to: (i) reschedule the services; (ii) grant credit; or (iii) make a partial or total refund actually received for unearned services, deducting administrative expenses, bank commissions, non-recoverable costs, third-party charges, and services effectively rendered.
· This exclusion of liability shall not apply in cases of willful misconduct or gross negligence directly attributable to CAMPOS POLANCO as duly determined by a competent authority.
28. COMPLAINTS
· In case of complaints, claims, suggestions, or dissatisfaction with the services provided by CAMPOS POLANCO, send an email to management@campospolanco.com.
· Cases not provided for in these REGULATIONS shall be governed by the General Tourism Law, its regulations, and other applicable provisions on the matter.
29. INAPPROPRIATE CONDUCT
· CAMPOS POLANCO reserves the right of admission and stay in accordance with applicable legislation and may deny access or request the immediate removal of any USER who:
(i) engages in aggressive, violent, discriminatory, intimidating conduct, or conduct that disrupts order;
(ii) puts at risk the safety, tranquility, integrity, or health of other GUESTS, USERS, or staff;
(iii) performs illegal acts or acts contrary to law;
(iv) breaches these REGULATIONS; or
(v) causes damage to the HOTEL, ROOMS, COMMON AREAS, or third parties.
· CAMPOS POLANCO may request assistance from private security and/or competent authorities when it deems necessary to safeguard the safety and integrity of persons and the HOTEL.
30. EARLY TERMINATION OF ACCOMMODATION
· CAMPOS POLANCO may terminate the SERVICE early and request the immediate vacating of the ROOM without any liability and without obligation of refund when USERS:
(i) breach these REGULATIONS;
(ii) engage in illegal activities;
(iii) damage HOTEL property or third-party property;
(iv) affect the tranquility, safety, or health of other GUESTS or staff;
(v) provide false information or documentation;
(vi) engage in conduct related to fraud, human trafficking, prostitution, exploitation, consumption, or commercialization of illegal substances; or
(vii) fail to comply with payment obligations.
31. PRIVACY NOTICE
· The personal data provided by the GUEST are those indicated in the REGISTRATION FORM: full name, address, identification, nationality, telephone number, email address, bank card details: card number and bank, for the purpose of fulfilling this AGREEMENT and conducting surveys regarding the contractual relationship between us, which shall be governed under the terms of the PRIVACY NOTICE made available herein and remaining available at www.campospolanco.com.
· Both parties shall maintain absolute confidentiality regarding the information or documentation exchanged under this AGREEMENT, even if not marked as confidential, and may not disclose, communicate, duplicate, or transmit it in any manner, unless there is an order issued by a competent authority.
